LANSING (WTVB) - The courts have tossed out a ballot initiative that would have expanded casino gambling to Grand Rapids and 7 other cities. The Michigan Court of Appeals has ruled the initiative would directly conflict with two other initiatives passed in 2004 and 1996 without reversing or amending them. You can’t do that. John Truscott with Protect Mi Vote, the group that challenged the initiative says they could take it to the state Supreme Court but the case is fairly clear cut. Specifically two of the three judges are directing the Secretary of State and the State Board of Canvassers to declare the ballot language unconstitutional. The third judge agreed it is unconstitutional, but she would just advise and not command the Secretary of State to act.
