DEARBORN (WKZO) -- Ford Motor Company is facing a class action lawsuit filed in California over its mileage claims for the 2013 Fusion and C-Max hybrid vehicles. California-based law firm McCuneWright is alleging the automaker has committed fraud and negligent misrepresentation in its claim that the vehicles get 47-miles-per-gallon.
Richard Pitkin of Roseville, California bought a C-Max Hybrid roughly four months ago, and filed the lawsuit after he says he was only able to get an average of 37-miles-per-gallon. Consumer Reports also found the two vehicles weren't getting the performance Ford promised and marketed, with their research getting numbers similar to Pitkin's for both models.
The Environmental Protection Agency will review the claims made by Ford.
