DETROIT (WHTC) - An Ottawa County judge is in hot water with the Michigan Judicial Tenure Commission over his conduct of a hearing last December that led to an attorney being thrown in jail for contempt of court. The commission Tuesday filed a formal complaint against 58th District Judge Kenneth Post, accusing him of misconduct in office, failure to be faithful to the law and using improper demeanor toward a lawyer. Judge Post, of Hudsonville, last December ordered attorney Scott Millard jailed after Millard told his client not to answer a question about whether he would fail a drug test. The attorney argued the question violated his client’s Fifth Amendment right against self-incrimination. The complaint also accuses the judge of conduct that was demeaning toward Millard.
