Businessman Follieri was jailed for four-and-a-half years in December 2008 after pleading guilty to 14 counts of wire fraud, conspiracy and money laundering.

Hathaway had dumped him shortly before he was arrested over a $3.6 million (£2.25 million) investment scam, and later admitted the scandal had made her ""more wary"" of men.

Follieri is due to be released from prison on Thursday after serving almost four years of his sentence and will be deported to his native Italy, according to New York Post gossip column Page Six.

The Devil Wears Prada star Hathaway is currently engaged to fellow actor Adam Shulman.
