BATTLE CREEK, MI (WKZO) -- After four years in the cold case file, the 2007 death of a four year old Battle Creek boy has generated new charges against the original suspect in the case.
In fact Adam Markos was just one day away from going on trial for the death of four-year-old Dominic Munoz 5 years ago when the prosecutor dropped the charges, vowing to re-file when new evidence or new science made it possible to prove the case.
A new prosecutor, David Gilbert says he has some new evidence that will be presented at Preliminary Exam.
Defense Attorney Tom Schaeffer says he has witness testimony and evidence that will implicate someone else in the crime.
The boy, who was the son of Markos’ ex-girlfriend, died from blunt force trauma and doctors say he also showed healing injuries from previous abuse when he died in August of 2007. The 30-year-old Markos is being held without bond on a charge that could get him life.
