ANGOLA, IN (WTVB) – A rural Angola man was shot to death on Wednesday and his son is being held in the Steuben County Jail on a preliminary charge of murder.
The Steuben County Sheriff’s Office is investigating the death of 51-year-old Rusty Smith of rural Angola .
He was found dead from a gunshot wound near his home on West 400 North east of Lake Gage.
Sheriffs deputies and police officers found the body near the road after Steuben County 911 received a call about a man who was possibly shot at about 12:26pm.
Witnesses told investigators that Smith’s 25-year-old son Cody fled in a car. He was accompanied by 24-year-old Carley Carter of Hudson, Indiana and her infant child.
Police from several agencies searched for nearly three hours before Smith, Carter and the child were found at a home on West Nevada Mills Road.
Smith and Carter were arrested without incident while the unharmed infant was turned over to the Indiana Department of Child Services.
While Smith was booked on the preliminary murder charge, Carter was released with no charges.
Results of the investigation will be forwarded to the Steuben County Prosecutors office for further review and formal charges.
Smith is also being held on an active Body Attachment warrant with a $1,000 bond.
