COLDWATER, MI (WTVB) – Branch County Prosecutor Zach Stempien has determined that the death of David Algarin Junior on August 6, 2023 was the result of justified deadly force by the responding deputies and that no charges will be filed in connection with the incident.
Algarin was shot and killed after a pursuit was initiated in St. Joseph County. He was a suspect in a double homicide that had taken place near Sturgis the previous day.
After a long, high speed pursuit, Algarin crashed into a wheat field on M-86 near Ambs Road which is at the Branch-St. Joseph County line.
After crashing into the wheat field, Stempien said in a statement released by his office that St. Joseph County deputies shot and killed Algarin when he refused to put his hands up and raised a pistol towards the deputies.
Stempien’s ruling came after a Michigan State Police investigation.
An autopsy determined that Algarin sustained 18 gunshot wounds to the head, neck, and torso.
