MARSHALL, MI (WNWN/WTVB) – The Michigan Court of Appeals agreed to a request from opponents of the Ford Motor Company BlueOval Battery Park this week to fast track their appeal of a judges decision to throw out their lawsuit.
The Battle Creek Enquirer reports the court on Tuesday granted a motion filed by the Committee for Marshall – Not the Megasite to expedite their appeal in its case against the city of Marshall, City Clerk Michelle Eubank and the Marshall Area Economic Development Alliance.
The citizens group filed suit last year after their petition to force a community vote on the rezoning of 700 acres of land between 13 and 15 Mile Roads for the electric vehicle battery factory was ruled insufficient.
They filed an appeal after the lawsuit was thrown out by Circuit Judge William Marietti almost two months ago.
Some are expecting the legal battles to go all the way to the Michigan Supreme Court.
Meanwhile, construction continues at the Battery Park along Michigan Avenue in Marshall. The plant is scheduled to open in 2026.
