COLDWATER, MI (WTVB) – A public hearing will be held during next month’s Coldwater Planning Commission meeting about potentially eliminating marijuana grow establishments from the special land use approval process for property within the city that is zoned industrial.
By consensus, the Planning Commission gave the go ahead on Monday night for the public hearing to be scheduled for October 7.
There have been discussions for almost two years about taking this action.
Grower and excess grower licenses are presently permitted in D-2 Heavy Industrial zoned areas with special land use approval.
Special land use approval is also needed for Microbusinesses to operate in areas zoned C-4 General Business.
Four special land use requests have been approved since May of 2021 but as City Manager Keith Baker pointed out, Craft Leaf LLC at 211 West Garfield Avenue is the only location that has been licensed through the State of Michigan and the City of Coldwater.
No one has applied for or received approval for a microbusiness.
City Attorney Amanda O’Boyle says the Craft Leaf business would not be affected by the proposed changes.
She proposed in her memo to the Planning Commission that a sunset date be set that would render any pre-existing marijuana grow licenses within the D-2 District legal non-conforming uses.
O’Boyle added the provision permitting marijuana retailers as an accessory to marijuana grows and processors was not removed.
