COLDWATER, MI (WTVB) – An ongoing legal battle between the City of Coldwater and Thompson Construction of Coldwater over 2023 repaving work is now scheduled to go into the new year.
A final pre-trial conference has been scheduled for March 4, 2025 in Branch County Circuit Court which will be about 14 months after Thompson initially sued the city.
The legal maneuvering in recent months has led to 10 parties being involved in the lawsuit. The City of Coldwater was one of three parties to file for a partial summary disposition. The request was taken under advisement by Branch County Circuit Judge Bill O’Grady during a hearing Thursday.
The lawsuit was filed by Thompson after the company claimed the city withheld money for the work they performed during a local street milling and overlay project. City officials felt the work was not completed properly.
The Coldwater City Council approved a bid in late May of just under $225,000 from Lakeland Asphalt of Battle Creek to redo the work on Sauk River Drive from Michigan to Sprague, South Sprague from U.S. 12 to Pearl and Chestnut Run from Bishop Avenue to Northshore Drive.
Frustrations with street construction delays in the summer of 2023 reached the boiling point for some Coldwater residents. It was a difficult summer for those who lived near Heritage Park as streets near the park were milled but left unpaved for several weeks.
