COLDWATER, MI (WTVB) – The Branch County District Court preliminary examination for an Angola, Indiana man who is facing charges in connection with the deaths of three children in a June 7, 2019 Algansee Township traffic accident has been rescheduled.
The preliminary examination for 21-year-old Tyler Frye was originally scheduled for Tuesday, but a motion for adjournment filed by defense attorney Fred Taylor of Kalamazoo was granted Monday. The hearing is now on the docket for August 8, 2019.
A preliminary examination is held to determine if there is enough probable cause to send the case to Circuit Court for trial.
Frye is free after posting bond. His bond was originally set at $500,000 but it was lowered to $200,000 with ten percent allowed at the request of the defense during a motion hearing last Thursday.
Terms remain the same. Frye can not have any alcohol and he not allowed in any bars. He must also undergo random drug and alcohol testing to make sure he is following the conditions of posting bond.
Frye is facing six charges including three counts of Operating Under the Influence of Liquor, Causing Death.
Michigan State Police say 6-year-old Lillian Graber, 4-year-old Moses Graber and 2-year-old Jacob Graber died after a pickup truck driven by Frye hit the back of their Amish horse-drawn carriage on Kelley Road south of Lester Road. Their mother and another child were seriously injured.
