COLDWATER, MI (WTVB) – A Coldwater man was formally charged in Branch County District Court on Tuesday with four counts including three for resisting members of the Michigan State Police following a violent confrontation at a Bethel Township residence.
49-year-old Brett Donley was charged with assault by strangulation after he was accused of putting his hands around the neck of another man and applying pressure during an argument which caused difficulty in breathing for the alleged victim.
The alleged victim managed to get away and told police at a nearby party store what happened. Police went back to the residence where they executed a search warrant for the suspect.
According to court documents, the suspect refused to cooperate with police as they tried to execute the warrant and eventually assumed a fighting posture. Police had to deploy a taser but the suspect managed to take out one of the barbs and continued to disobey verbal commands. Donley eventually followed commands and was taken into custody.
Court documents also show Donley’s criminal history goes back to 1990 as Prosecutors have filed an habitual offender fourth offense notice.
Bond was set at $15,000. A probable cause was set for June 24 with a preliminary exam on June 29.
