COLDWATER, MI (WTVB) – Mastronardi Produce in Coldwater has been taken to court by three former workers who claim they were regularly exposed to dangerous pesticides without protection and were denied bonuses.
The class action lawsuit was filed in the U.S. District Court for the Western District of Michigan by the Michigan Immigrant Rights Center and Farmworker Justice.
Besides their claims about the pesticides, plaintiffs Benjamin Lopez, Oscar Carlos Lopez Ramirez, and Ramona Reyes Saucedo say Mastronardi failed to pay them promised bonus for meeting production standards by continually increasing the amount of work that had to be completed to receive a bonus, changing how bonuses were calculated, and under counting their work.
Mastronardi is also accused of incorrectly classifying Saucedo as an agricultural worker and failing to pay her overtime wages when she was employed as a janitor.
Mastronardi is not commenting on the lawsuit.
