LANSING, MI (WTVB) – Branch County’s representative in the State Senate was one of 11 state lawmakers who suffered a legal defeat last week as their federal lawsuit challenging voter-approved amendments to the Michigan constitution involving elections was thrown out.
State Senator Jonathan Lindsey was the lead plaintiff in the litigation that claimed Proposal 3 in 2018 and Proposal 2 in 2022 blocked state legislators to enact laws involving times, places and manner of federal elections.
U.S. District Court Judge Jane Beckering ruled last Wednesday that Lindsey, described as a “far right-wing” Republican from Brooklyn, and his fellow litigants had no standing to sue, and didn’t establish how passage of these two proposals did them any injury or harm.
Lindsey said the ruling was politically motivated.
Michigan Attorney General Dana Nessel said, “This lawsuit was absurd and baseless from its inception, and I am glad the Court saw the plaintiffs obvious lack of standing.”
An appeal of Beckering’s ruling is expected.
