COLDWATER, MI (WTVB) – The case of a Sherwood man who along with his wife are facing charges for allegedly misusing a debit card belonging to a nearby elderly couple has been bound over to Branch County Circuit Court.
47-year-old Kory Olmstead and his 43-year-old wife Jennifer have both been charged with four counts of stealing or retaining without consent a financial transaction device.
Kory Olmstead waived his Branch County District Court preliminary examination on Tuesday. He is now scheduled to appear for a Circuit Court pre-trial conference on May 6.
A District Court preliminary exam for Jennifer Olmstead is scheduled for next Thursday, April 25.
Not guilty pleas have been entered on behalf of the Olmsteads.
According to court documents, the Branch County Sheriff’s Department received a fraud complaint from Adult Protective Services on February 3, 2023.
It was a month after the elderly couple’s wife had a conservator appointed her. The conservator said there were numerous suspicious charges on bank statements for the couple after they gave a debit card to the Olmsteads to buy groceries.
Jennifer Olmstead said they always returned the card with the receipt and never used it other than for groceries.
However, the conservator claims there were numerous charges at such places as restaurants, bars, liquor stores and the casino that don’t appear to be made by the elderly couple. According to court documents, there were four alleged incidents between September 10 and November 16, 2022.
