COLDWATER, MI (WTVB) – Following a recommendation from the Coldwater Planning Commission, the Coldwater City Council voted 7-2 on Monday to introduce an ordinance that would eliminate marijuana grow establishments from the special land use approval process for property zoned industrial within the city.
Council member Jim Knaack asked City Attorney Amanda O’Boyle if the proposed ordinance opens up the city to legal action.
Four special land use requests have been approved since May of 2021 but only Craft Leaf LLC at 211 West Garfield has been licensed by the State of Michigan and the City of Coldwater. O’Boyle said some limitations would be placed on Craft Leaf.
The smell from these types of businesses has been one of the concerns.
Council member Emily Rissman cast one of the no votes.
John Petzko also voted no. The second reading and final adoption is scheduled for October 28.
There have been discussions about taking this step over the last two years.
Grower and excess grower licenses have been permitted in D-2 Heavy Industrial zoned areas with special land use approval.
Special land use approval is also needed for microbusinesses to operate in areas zoned C-4 General Business.
There have not been any applications for a microbusiness.
