COLDWATER, MI (WTVB) – A Battle Creek man will spend a year in jail for causing an crash that left a woman with permanent injuries.
26-year old Jordan Robinson was sentenced by Branch County Circuit Judge Bill O’Grady, after pleading guilty to reckless driving causing serious impairment of body function in a crash that occurred in September 2023 near the intersection of Jonesville and Marshall roads.
Prosecutor Zack Stempien said the victim suffered long term and short term memory loss and will probably never recover. He said a it’s a case that he normally would have seeked prison time for, but due to evidentiary issues he had to seek a plea deal.
Defense attorneys called into question the test kit used for a blood draw that revealed a blood alcohol level of .10, The test kit was out of date by 14 months, in addition MSP Troopers who conducted a field sobriety test could be heard on body cam video saying they didn’t believe Robinson was impaired.
As per the plea deal, Robinson will serve one year in the Branch County Jail, and the felony conviction will be dismissed after three years of probation are completed successfully, however the misdemeanor charge of moving violation causing serious impairment to body function will remain on his record.
Robinson did express remorse for the accident during sentencing.
