COLDWATER, MI (WTVB) – Due to a requirement by the state’s Enviromental, Great Lakes and Energy Department, Branch County needs to adopt a Soil Erosion and Sediment Control policy with enforcement action.
The Branch County Board of Commissioners decided during their work session on Thursday to bring forward a proposed policy covering civil infractions and enforcement procedures to their next regular meeting on June 24. Formal action is expected at that time.
Branch County Prosecutor Zach Stempien is reviewing the policy and Administrator Frank Walsh says Stempien may offer some minor amendments.
The policy calls for a warning to be initially issued for violations. If nothing happens for five days, a written notice of violations and/or a stop work order would then be issued.
If a contractor or landowner continue to work, they would then face a civil infraction and the county Prosecutors office would then be notified.
