COLDWATER, MI (WTVB) – The Branch County Board of Commissioners approved a resolution on Tuesday that was requested by Drain Commissioner Mike Hard which sets a Special Assessment Roll and Computation of Costs for the Coldwater-Marble Lake Chain lake level.
The Commissioners action came after a public hearing was held on August 5. Hard then reviewed feedback and information received from property owners regarding the proposed special assessment. Revisions were made based on the feedback.
The total amount assessed is $165,000 with $113,850 or 69 percent being assessed to property owners in the district.
Most owners of the more than 2,500 parcels in the district would pay between $21-and-68 cents and $43-and-36 cents based on lake access.
The resolution established a special assessment district which was confirmed by the Branch County Circuit Court for the Coldwater-Marble Lake Chain.
Those who wish to appeal the special assessment roll can file legal action within 15 days of its adoption.
A couple of audience members told Commissioners the county should wait until the Michigan Supreme Court makes a decision on a case involving a Special Assessment District on Higgins Lake in Roscommon County.
The Roscommon County Circuit Court’s decision which confirmed the boundaries of the lake has been affirmed by the Michigan Court of Appeals.
