COLDWATER, MI (WTVB) – A Branch County Circuit Court jury trial in a criminal sexual conduct case was called off Tuesday morning.
William Anthony Waters was facing three C.S.C. counts including a first degree charge. The case was bound over to Circuit Court in December 2016.
But Prosecutor Scott Smith requested that the charges be dismissed without prejudice when the alleged victim and her father did not appear in court. The request was granted by Judge Bill O’Grady.
The judge also granted a request that a bench warrant be issued for the father with bond to be determined.
A court official said there were nearly 80 potential jurors who had to be sent home when the case was dropped.
