COLDWATER, MI (WTVB) – A Detroit man who was arrested last August on I-69 in Kinderhook Township when a traffic stop turned into the discovery of cocaine and heroin in his car will not have to serve any more jail time.
35-year-old Brandon Smiley had earlier entered no contest pleas to attempted possession of less than 25 grams of heroin and cocaine.
The plea bargain ended a trial for Smiley on two counts for Delivery and Manufacturing Narcotics less than 50 grams and for being an habitual offender.
He was given a nine month sentence on Monday and placed on two years probation. Smiley was given credit for 123 days already served in the Branch County Jail. The rest of his executed time was suspended.
Smiley was stopped by the Michigan State Police for not having a license plate. A temporary Indiana tag in the rear window was also expired.
Troopers say 22 grams of cocaine and another six grams of heroin were discovered behind the drivers side headlight.
