MARSHALL, MI (WTVB) – Marshall Area Economic Development Alliance has issued a statement in response to the State Supreme Court vacating a lower courts decision to dismiss a 2023 lawsuit against the city of Marshall over the Blue Oval Battery Plant.
A group named “The Committee for Marshall not the Megasite” claimed in the suite city leaders improperly voted to rezone the land to industrial use, and that Marshall City Clerk Michelle Eubank failed to count signatures in a petition filed that opposed the rezoning.
While the committee claimed it submitted more than 800 signatures as part of its voting effort, only 136 were deemed valid by Eubank.
The Marshall Area Economic Development Alliance CEO James Durian, released a statement saying,
“Ford’s BlueOval Battery Park Michigan continues to move forward creating new jobs and bringing in tax revenues for the local community, as we review this decision with our legal team. Ford is currently paying taxes on the property and there are 2,200 workers on site every day, contributing to the local economy. Ford has already completed steel construction on the primary facility, which is expected to begin production next summer.”
In early 2024, a Calhoun County Circuit Court judge dismissed the lawsuit. The Michigan Court of Appeals upheld that decision a few months later.
The Court of appeals has not yet set a date to revisit the case.
